Acceptance of the Terms of Use

The Terms of Use and our Privacy Notice apply to all users of the Online Services owned or operated by electricminds.co.uk, Inc. or its affiliates (“we”, “us”, “our” or “Hearst”).

By accessing and using the Online Services, you agree that we may use information about you in accordance with our Privacy Notice.

Additional terms apply if you purchase a digital membership or subscription (referred to as a Digital Membership Product).

If you buy a print subscription, there are additional terms about auto-renewal and continuous service (“Continuous Service Program”).

Your Duties

  • You are responsible for the accuracy of any information you submit to us in connection with your use of the Online Services.
  • Any user content you submit to us is solely your fault.
  • Your conduct in relation to the Online Services is subject to the rules described in the section entitled “Your Conduct and Responsible Use of the Online Services” of the Terms of Use below.

Rights of Ownership

Your use of the Online Services and Content is strictly noncommercial.

Except for your User Content, Hearst owns all worldwide copyrights, trademarks, service marks, trade names, patents, and other intellectual and proprietary rights associated with the Online Services and Content.

You may not create derivative works or materials using any portion of the Online Services (including any code used in any software) or Content, for profit or not.

We may suspend or terminate a user’s access to the Online Services if we discover that they have repeatedly violated third-party proprietary rights. Please note that we reserve the right to review any User Content, investigate and/or take appropriate action against you.

Disclaimers and Limitations of Liability

You agree to defend, indemnify, and hold harmless Hearst (and its affiliates, officers, directors, employees, contractors, and agents) from any third-party claim or demand arising from or related to (a) your use of the Online Services or Content, (b) your User Content, (c) your violation of the Terms of Use, or (d) your violation of applicable laws or regulations.

Aside from that, Hearst provides the Online Services “as is”.

Our liability is limited as described in the Terms of Use below.

Parties

Hearst disclaims any responsibility for third-party websites, apps, or services, including social media.

For some of our Online Services, we allow third-party affiliate links to be encoded. This means we may get paid if you click on or buy through third-party affiliate links.

Termination

Hearst reserves the right to remove and discard any User Content (as defined in the Terms of Use below) or information stored, sent, or received via the Online Services without prior notice and for any reason.

Terms of Use Changes

It is possible that we will update the Terms of Use on the Online Services.

Continued use of the Online Services constitutes irrevocable acceptance of all revisions.

Law

No other jurisdiction’s laws shall apply to the Terms of Use.

There are no other agreements between you and us regarding the use of the Online Services.

When a provision of the Terms of Use is found to be invalid or unenforceable by a court, the other provisions remain unaffected and the invalid or unenforceable provision is deemed modified to the maximum extent permitted by law.

Copyright Law

If you believe your copyright has been violated, you may notify us as described in the Terms of Use section below.

Use Rules

1. Acceptance of this Agreement

We, us, our, or Hearst are a contract in electronic form between you (“you,” “your,” and “yourself”) and Hearst (the “Agreement”). This Agreement governs your access to and use of the Online Services. That includes third parties who may advertise or sponsor content, products or services on the Online Services or third-party platforms (such as social media platforms or app stores) (as defined below).

Only general information, discussion, and entertainment is provided by the Magazine. For the avoidance of doubt, “Content” refers to all material and information provided by or in connection with the Online e Services, whether publicly posted or privately transmitted. We make no representations or warranties about the Online Services or Content and do not endorse any user opinions. USE OR RELIANCE ON THE Online SERVICES OR ANY CONTENT IS AT YOUR OWN RISK. The magazine services and content are provided “as is” with no warranty of any kind.

2. Information & Communication Methods Accuracy

Your account creation, registration, or membership information must be complete and accurate. You must maintain the accuracy of such data. To terminate, suspend, or refuse access to the Online Services, we may believe your information is not true, accurate, or current.

This includes payment authorizations, invoices, password or payment method changes, confirmation messages and notices, which we may send to the email address you provided during registration. It is understood that any electronic communications we send to you will satisfy any legal communication requirements, including that such communications be in writing.

3. Age and Legal Capacity

The Online Services are not intended for children under the age of 13. To use the Online Services or provide us with information, you must be at least 13 years old.

4. Password and Other Credentials

To access the Online Services or certain features or portions of the Online Services, you must create a username, password, and other credentials (collectively, “Credentials”). We are not responsible for any unauthorized use of your Credentials by third parties. You agree to notify Hearst immediately of any unauthorized use of your Credentials or other security breach. We are not liable for any loss or damage caused by unauthorized use of your Credentials or your failure to comply with this Agreement.

5. Intellectual Property Rights

Your use of the Online Review Services and Content is strictly noncommercial. The following restrictions apply to your rights under this Agreement:

You may not remove, alter, interfere with, or circumvent I any copyright, trademark, or other proprietary notices marked on the Online Services or Content, or (ii) any digital rights management mechanism, device, or other content protection or access control measure associated with the Magazine. You may not modify, disassemble, reverse compile, or reverse engineer any part of the Online Services or Content.

A perpetual, nonexclusive, royalty-free and fully paid license to use your User Content is granted to Hearst. You represent and warrant that you have the right to grant such a license. Any claims or assertions of moral rights or attribution with respect to your User Content are irrevocably waived.

User Contributions

Submissions

We may suspend or terminate a user’s access to the Online Services if we discover that they have repeatedly violated third-party proprietary rights. Please note that we reserve the right to review any User Content, investigate and/or take appropriate action against you. They can remove or modify your User Content, terminate your access to the Online Services (including any user account, registration, or membership), take legal action against you, or report you to law enforcement. If Hearst chooses to modify User Content, it does so at its own risk.
